Terms & Conditions

These Terms and Conditions apply to purchases from With Love in Song.

 

1. Our service

We create personalised songs using the information, memories and preferences submitted by customers. Our creative process may involve human writing, editing, AI-assisted tools and digital music-production services.

 

2. Eligibility

You must be at least 18 years old and legally capable of entering into a contract to place an order.

 

3. Placing an order

An order is accepted when:

  • We receive successful payment;

  • You complete the required questionnaire; and

  • We confirm that the order has been accepted.

You are responsible for ensuring that the information supplied is accurate and complete.

 

4. Prices and payment

Prices are displayed on the website before checkout. Payment must be made using an available payment method.

Your bank or payment provider may apply currency-conversion or international transaction charges. These charges are outside our control.

If you are charged twice because of a technical error, contact us so that the duplicate payment can be investigated and refunded.

 

5. Production and delivery

The estimated production time begins once payment and the completed questionnaire have been received.

Delivery times are estimates unless we expressly agree to a fixed deadline. We are not responsible for delays caused by incomplete information, incorrect contact details or events outside our reasonable control.

 

6. Creative interpretation

A personalised song is a creative product. By ordering, you accept that:

  • Lyrics, melody, arrangement, instruments and vocal delivery involve creative judgement.

  • A requested genre, mood or vocal preference is guidance rather than a guarantee of an exact result.

  • We cannot create an exact imitation of a living artist or guarantee that a song will sound identical to a particular commercial recording.

  • Minor differences between your expectations and the creative result do not automatically mean the service is defective.

 

7. Revisions

The number of versions or revisions included depends on the package purchased.

Revision requests must:

  • Relate to the information originally submitted.

  • Be made within 14 days of delivery.

  • Be clear and reasonably achievable.

New stories, a different genre, a complete rewrite or changes outside the purchased package may require an additional fee.

 

8. Customer-submitted material

You retain ownership of photographs, stories and other original materials you submit.

You give us permission to use those materials only as necessary to create, administer and deliver your order.

You confirm that:

  • You are entitled to submit the information and materials.

  • Their use will not infringe another person’s rights.

  • You have appropriate permission to provide personal information about other people.

  • The content is not unlawful, threatening, discriminatory, defamatory or deliberately misleading.

We may refuse content that is unlawful, abusive or likely to cause serious harm.

 

9. Use of the finished song

Unless otherwise agreed, you receive a continuing licence to download, play, gift and share the finished song for personal, non-commercial purposes.

Commercial advertising, resale, commercial distribution, monetised release or use on behalf of a business requires written permission or a separate commercial licence.

Because AI-assisted material may be involved, the copyright status of particular elements can vary between countries. We grant only the rights that we own or are authorised to grant.

We will not publicly use your song, story or photographs for marketing without your permission.

 

10. Cancellations and refunds

Cancellations and refunds are governed by our Refund Policy and applicable consumer law.

Because each song is personalised, cancellation rights may become limited once you expressly request that production begins.

Nothing in these terms removes statutory rights relating to faulty, misdescribed or improperly supplied digital content or services.

 

11. Third-party services

Our website, checkout, questionnaires and production process may use third-party platforms. We are not responsible for temporary failures of services outside our reasonable control, but we will take reasonable steps to complete or redeliver your order.

 

12. Liability

We do not exclude liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

Subject to mandatory consumer rights, our total liability relating to an order will not normally exceed the amount paid for that order.

We are not responsible for indirect business losses where the song was purchased as a consumer product.

 

13. Governing law

These terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere, you retain any mandatory consumer protections that apply in your country of residence.
